MODEL, talent, CLIENT & AGENCY
The model / talent (Artist) engages Excel Model Management (Agency) to be their Agent Representative and the Agency has the artist’s authority to enter into contracts with any and all Clients on their behalf.
A contract is created between the Client and Artist once a booking is confirmed with the Agency. This can be written, written and partly oral or wholly oral.
It is the responsibility of the Client to ensure that they have adequate levels of insurance to cover all Artists used at all locations.
The model / talent is to be paid for the amount agreed to even if the job starts late or finishes earlier than the originally booked. If the job takes longer an overtime rate will be applied.
Clothes fittings, hair, and makeup time with the model / talent will be charged at the Artist’s normal rate. Where a model / talent is required to wear a bathing suit or underwear, the client must obtain written approval from Excel prior to booking. Excel does not permit any nudity or implied nudity of the models we represent.
Travel time is charged at the Artist’s normal rate. This applies to travel outside a 30km radius of the CBD. Travel Days can be discussed with the agent.
All images of the artist are to be used for the purpose for which they were originally shot as itemised in The Agency Booking Confirmation signed by the Client at the time of booking. It is the client’s responsibility to notify The Agency of any intended usage before the commencement of the shoot.
Clients may not use images until payment in full has been received.
Ownership of all images of the Artist remains with Artist at all times and any unauthorised use or replication of their image will be an infringement of Australian Copyright Laws. Photographers, therefore, agree to restrict use of his/her copyright, and if the Client is not a photographer, the client is to draw these terms and conditions to the attention of the photographer and to obtain their agreement prior to the commencement of the shoot. Photo approval for portfolio use by the photographer must be attained from The Agency.
Artists can work for competitive or conflicting products at all times unless ‘Exclusivity Rights’ have been negotiated with the agency and paid for.
Cancellation fees apply with less than Two Working Days Notice prior to the commencement of the booking, a cancellation Fee of 50% of the total Artist Fee for the booking will be charged. With less than One Working Days Notice prior to the commencement of the booking, a cancellation Fee of 100% of the total Artist Fee for the booking will be charged.
The Agency act solely for and on behalf of our Artist. Therefore while Excel Model Management only represents professional artists we cannot be held ultimately responsible for an artist's conduct on an assignment. Although conduct deemed inappropriate by the agency may impact the artist's future bookings and representation by the agency.
Payment is required within 7 days from the date of invoice where an approved credit account has been set up. Payment can be made by, Electronic Funds Transfer to our bank account (bank details appear on all invoices). In all cases, the client booking the model will be invoiced and solely responsible for payment unless otherwise agreed to and confirmation given prior to the commencement of the booking.
If the Client fails to pay the amounts due, in accordance with these terms and conditions, they will be responsible to pay for all expenses and costs incurred in recovering any outstanding monies, including debt collection fees and Solicitor’s costs.
Where a booking is made by a third party to bill the Client and that person is not legally associated with the Client, then the person/business that made the booking will be held liable for any non-payment of a booking by the Client.
