
model/talent agreement

The Model/Talent (Talent) appoints the Agent/Agency (Agency) as their representative for the purpose of obtaining and negotiating modelling assignments as outlined in this Agreement.
This Agreement shall commences on date of submission of this form and shall continue for a period of 12 months. The term may be extended by mutual Agreement of the Parties (Agenty and Talent). Either party may terminate this Agreement with written notice. Immediate termination may occur if the Talent engages in misconduct or illegal activity damaging to the Agency’s reputation.
The Agency is an independent contractor. Nothing in this Agreement creates a relationship of employment, partnership or joint venture between either party.
The Agency will:• Promote the Talent to clients in the fashion, commercial, and related industries.• Negotiate contracts and bookings on the Talent’s behalf.• Collect and disburse payments following receipt of invoices from Talent for assignments.
The Talent agrees to:• Make themselves reasonably available for assignment and respond to inquiries in a timely manner.• Act professionally at assignments• Provide accurate and up to date portfolio images.
• Notify the Agency of changes in availability and/or changes in appearance ie new tattoos, measurements/clothing sizes, hair colour or dramatically different hair styles.
The Talent shall not present themselves as an employee or representative of the Agency beyond the scope of this Agreement
The Agency shall be entitled to a commission of 20% from modelling work secured through the Agency. The Agency will deduct its commission prior to payment. Note: You may wish to inquire with your accountant if this is tax deductable and include the agency commission on your invoice as an expense.
The Agency shall invoice clients and collect payment on behalf of the Talent. The Agency shall pay the Talent their earnings (after commission) after receiving full payment from the client. The Model being a sole trader/contractor/independant contractor is responsible for any tax obligations, superannuation, insurances and any other statutory requirements associated with self-employment. The Talent grants the Agency and its clients the right to use the Talent’s name, image, likeness, and other materials for promotional purposes related to modelling and assignments. The Talent warrants that they are legally entitled to work in Australia and are not bound by any conflicting representation agreements. If the Talent is under 18, a parent or legal guardian must submit this Agreement and include their contact information below. This Agreement and the Terms and Conditions published at excelmodelmanagement.com.au outline the full terms and conditions of the Agreement between the Talent and Agency. All previous Agreements between the parties, if any, whether written or oral, are merged herein and superseded hereby. Updated January 2026
